Terms & conditions
1. Introduction
These terms and conditions apply to the use of the website and to the booking of Villa Kingfisher (“the Villa”). Bookings are handled exclusively through our Lodgify platform. Each stay is governed by a Rental Agreement between PT PMA. King FIsher Lembongan and the guest in whose name the booking is made (“the Guest”).
2. Reservation Policy & Payment
Following confirmation of availability, payment must be completed via Lodgify within 48 hours.
Down Payment: 20% of the total rental sum is due at the time of booking.
Balance Payment: The remaining 80% must be paid no later than 75 days before arrival.
Non-refundable: All paid prepayments are strictly non-refundable.
Confirmation: Upon receipt of the down payment, Lodgify will send a confirmation email with reservation details and a reference number.
Bookability: Reservations are accepted via instant booking.
3. Taxes and Additional Charges
Tourist Tax & Service Charge: A one-time surcharge of 20% per stay is levied for tourist tax and service charges.
Included: The base rental price includes electricity, water, cleaning, and garden maintenance.
Provisioning: Costs for groceries and supplies (provisioning) are the responsibility of the Guest.
Tips: Gratuities for the staff are optional and at the Guest's discretion.
4. Arrival, Departure & Access
Check-in
From 14:00 (2:00 PM) local time.
Check-out
No later than 11:00 (11:00 AM) local time.
Staff Access: The Guest agrees that staff (housekeeping, gardening, technical maintenance) may access the Villa at reasonable times to perform their duties. In case of emergency, staff or management may enter the premises at any time.
Registration: A valid passport is required for official registration upon arrival.
5. Security Deposit
There is no security deposit required. However, the Guest remains fully responsible for any damage or loss to the villa or its inventory. Damages caused by the Guest or their party will be charged through the Lodgify platform.
6. Use of the Villa and Rules
Number of Guests: The number of occupants must not exceed the maximum number of sleeping places indicated.
Events: Parties or events require prior written approval. Unauthorized events may lead to immediate termination of the stay without refund.
Quiet Hours: To respect the local community (Banjar), quiet hours are in effect from 22:00 (10:00 PM) until 07:00 (7:00 AM).
Pets: Pets are strictly prohibited in the Villa.
Local Legislation: Same-sex ceremonies are prohibited by law in Indonesia. Permits (Banjar) for events are beyond our control.
7. Safety & Liability Disclaimer
Pool & Beach: There is no lifeguard or supervision present at the pool or beach access points. Use of the swimming pool and access to the beach is entirely at the Guest's own risk.
Disclaimer: PT PMA. King FIsher Lembongan accepts no liability for any injury, accident, or drowning.
Supervision: Guests are solely responsible for the safety of children and non-swimmers at all times.
Prohibited: Illegal activities (gambling, drugs, weapons) are strictly forbidden. Smoking is only permitted in designated outdoor areas.
8. Cancellation Policy
All paid prepayments are non-refundable.
Cancellation > 60 days before check-in: Forfeiture of the down payment.
Cancellation 30–60 days before check-in: 50% of the total rental sum will be retained.
Cancellation < 30 days or no-show: 100% of the total rental sum will be retained.
Cancellation by the Villa: In case of cancellation by us (e.g., due to extreme natural disaster), you will receive a full refund via Lodgify.
9. Utilities & Force Majeure
Utilities: Due to the island location of Nusa Lembongan, intermittent outages of electricity, water, or internet may occur. PT PMA. King FIsher Lembongan is not liable for service interruptions caused by third-party providers.
Bali-specific Force Majeure: Neither party is responsible for failure to meet obligations due to force majeure. In the context of Indonesia/Bali, this includes but is not limited to: volcanic activity (including ash clouds and flight bans), earthquakes, tsunamis, or other natural disasters. These events do not automatically entitle the Guest to a refund unless the Villa itself is rendered uninhabitable.
10. Lost & Found
Any items left behind by the Guest will be kept for a period of one (1) month. After this period, items will be disposed of or donated. The Guest is responsible for all costs (shipping, handling, and insurance) associated with returning lost items.
11. Privacy Policy & Jurisdiction
We respect your privacy in accordance with the Indonesian Personal Data Protection Law (UU No. 27/2022). This policy is governed by the laws of the Republic of Indonesia. Disputes fall under the exclusive jurisdiction of the courts in Bali.
